戦前の日本において、神道の思想を日本から世界に拡大しようと試みた筧克彦の思想については、現在批判と肯定の両面から研究がなされている。しかし、批判するにせよ評価するにせよ、筧の思想についてはほとんどの場合「神ながらの道」の思想にのみ注目が集まっており、法学者であったはずの筧がなぜ宗教を語るようになったのか、どのような問題意識を持って研究を始めたのかについての研究は殆どない。そこで、本稿では一九〇〇年代における筧の思想を明らかにすることで、その学問の形成過程を明らかにしたい。\n そこで、筆者は筧が自由と主体の自覚的な活動(=筧の言葉でいえば「活働」)を重視していたことに注目した。筧克彦の議論の骨子は個人の自由と国家の自由というは互いに対立するものではなく、むしろ個人の自由を認めれば認めるほど、国家への寄与を深めていくようになるというものである。そのため筧の議論を批判するにしても評価するにしても、この論理を解き明かした上でなければならないであろう。\n
